1. Member agreement

These Conditions set out the contractual relationship between Smart City Prestige and each individual member of Prestige Circle.

2. Definitions

In these Conditions unless the context requires otherwise:

“SCP”: means Smart City Prestige Limited;

“smartcityprestige.com” means the Prestige Circle web pages, which will be changed from time to time, available on the SCP website at internet address www.smartcityprestige.com;
“Prestige Circle” means the SCP loyalty Membership scheme;
“Conditions ” means these Conditions of Use relating to the Prestige Circle’s loyalty Membership scheme as amended from time to time;
“Data” means data personal to a Member;
“Force Majeure” means unusual and unforeseeable circumstances which one cannot control and the consequences of which one could not have avoided even if one had taken all reasonable care;
“Fraud” includes fraud, dishonesty and deceit and in particular:

  • knowingly supplying incorrect information including at the time of booking to gain Tier Points;
  • attempting to gain Points by taking journeys that are not eligible for Points;
  • altering documents to gain Points,
  • attempting to gain Points for journeys taken by any person other than the Member unless you are an EA, PA or booker;
  • attempting to gain Points more than once for the same journey,
  • selling, bartering and/or purchasing Points or Rewards including attempting to sell or transfer Points or Rewards by means of internet based sales or auctions; or
  • knowingly benefiting from the Fraud or Misconduct of another Member or individual;

“Journey” means a single eligible journey between two locations;
“Lifetime Status” means Membership status for the duration of the Membership held by the Member that is offered by SCP to Members;
“Membership Number” means the membership number allocated in accordance with clause 3.5. of these Conditions;
“Marketing Partners” means companies selected by SCP to offer services, products or facilities to Members;
“Member” means the person who is a member of Prestige Circle and whose app or web profile has a Membership number;
“Membership” means membership of Prestige Circle;
“Misconduct” includes:

  • failure to comply with these Conditions or the terms and conditions of a marketing partner; or
  • attempting to obtain Points by Fraud; or
  • misusing the Services; or
  • misconduct on any SCP journey; or
  • misconduct in dealing with SCP’s staff or the staff of any Marketing Partner;

“Rewards” means any reward issued by, or other goods or services supplied by, or on behalf of SCP including promo codes and discount offers specific to particular Members

3. Membership

3.1 To become a Member, an individual must register on SCP’s website or via digital application form.
3.2 Members are automatically placed in the Prestige Circle earning Points as soon as they book and pay for a booking.
3.3 Some Members may be fast tracked into Membership and some into to a higher Membership Tier. This is offered at the discretion of Addison Lee and Addison Lee may refuse Membership to any customer or inclusion into any particular Membership Tier.
3.4 Members will be given a Membership number once reaching the Silver Membership Tier. Multiple Membership is not permitted and each Member must maintain only one profile. In the event that a Member has multiple Memberships, all Memberships (other than the first Membership approved by Addison Lee) will be cancelled.
3.4 Customers will be admitted to Membership on the date they register. Members agree to be bound by these Conditions (as amended from time to time) and the information on addisonlee.com
3.5 Correspondence will be sent to the Member’s email address then used when registering on the app or website. Addison Lee reserves the right to provide information to Members, including changes to the ClubLee programme.
3.6 Membership will terminate automatically upon the death of a Member, Tier Points accumulated but unused at the time of death shall be cancelled.
3.7 Prestige Circle is not a members’ or proprietors’ club.

4. Protection of Members’ Data

4.1 The Data which is processed by Prestige Circle in connection with Members may include:
4.1.2 Data about journeys booked or undertaken by the Member including Data identifying any account or non-account bookings;
4.1.3 Data supplied by the Member including their name, email and telephone number;
4.1.4 Data collected when the Member is provided with Rewards; and
4.1.5 Data collected when the Member is otherwise in contact with SCP (such as Data about use of smartcityprestige.com).
4.2 The sources of the Data Processed by SCP in connection with Members may include Marketing Partners, SCP may use older databases and other sources to link together Data.
4.3 Members consent to:
4..3.1 their Data being supplied to SCP,
4.3.2 their Data being transferred to other countries whether or not such countries have data protection laws.
4.4 The purposes for which Data may be processed by SCP or by another recipient of Data under 4.2 include:
4.4.1 providing Rewards to Members;
4.4.2 making changes to Rewards;
4.4.3 accounting and audit, safety and security, fraud prevention and investigation, and systems testing, development and maintenance;
4.4.4 the management and administration of Prestige Circle;
4.4.5 customer relations and Marketing Partners in future dealings with Members;
4.4.6 credit checking and credit scoring where permitted;
4.4.7 customer profiling and other marketing and market research analysis;
4.4.8 (by or on behalf of SCP) communicating to Members information about Prestige Club, including information about Prestige Club benefits, using any contact details provided;
4.4.9 (by or on behalf of SCP or Marketing Partners) communicating to Members about other products, services or facilities offered by SCP or other carefully selected companies, using any contact details provided;
4.4.10 conducting market research; and
4.4.11 any other purpose which is obvious or is communicated to the Member;
4.5 It is a term of Membership that Members consent to the use made of Data set out in 4.4.

7. Lifetime Status

7.1 Some Prestige Circle members may be awarded lifetime status. Lifetime status will be issued and controlled by SCP.
7.4 Lifetime Status is subject to these Conditions and is dependent on the Member’s continued membership of Prestige Circle and the continued operation of the Prestige Circle scheme. SCP reserves the right to amend the criteria for gaining Lifetime Status or to withdraw the ability of Members to earn Lifetime Status and will give at least 1 months’ notice of the change or withdrawal of this benefit.
7.5 Lifetime Status is not transferable and can only be awarded to the Member who has earned the required number of Points or at SCP’s discretion.

8.0. Prestige Circle Points

8.1 Points can only be earned for travel on eligible journeys at eligible fares with SCP and will be earned by a Member as set out on smartcityprestige.com
8.2 SCP may, from time to time, alter the rules for earning Points (for example, by altering eligible journeys or fares or the number of Points earned for specific journeys). Members will be notified in advance of any changes.
8.5. Points including Lifetime Points must be earned by the Member and are transferrable.
8.6 SCP may decide that Points may not be awarded for certain bookings.

10. General

10.1 From time to time, SCP may offer Rewards, special promotional codes to Members and such accruals and/or bookings will be subject to the terms and conditions as published with each offer and which take precedence over these Conditions. Promo codes and other Rewards may not be used in conjunction with other awards, promotions, coupons, discounts or special offers.
10.2 At no time may Rewards be purchased by, sold to, bartered to other persons.
10.3 SCP reserves the right to audit a Member’s web or app profile and records without notice to the Member to check for compliance with these Conditions. During an audit a Member may be unable to make Prestige Circle Reward bookings.

11. Member’s right to terminate membership

11.1 Members may terminate their Membership by writing to accounts@smartcityprestige.com stating that they no longer wish to be a Member. Any such termination will result in a loss of all Prestige Circle Points credited to a Member’s Membership account and does not relieve the Member of any continuing obligations under these Conditions.

12. SCP right to terminate Prestige Circle membership

12.1. In addition to any other rights SCP reserves the right at any time in its absolute discretion without compensation or notice to terminate the Membership of any Member and/or (if applicable) the right of having a Membership associated with their app or website profile, including cancelling all accrued and accruing Prestige Circle Points of the Member and any Prestige Circle promo or other Reward journeys.
12.2. The Member shall be liable to SCP for the full price of any travel undertaken on Prestige Circle promo \ Reward journeys, wholly or partly as a result of Fraud and/or Misconduct, with any reasonable costs, including legal fees, incurred by SCP.

13. Termination of Prestige Circle

SCP may terminate Prestige Circle at any time. SCP will attempt to give at least one months’ notice to Members and at the end of the period of notice, each Member acknowledges that they will no longer be able to gain Prestige Circle Points or use Rewards accrued or otherwise.

14. Modification or withdrawal of Prestige Circle Rewards

14.1. Prestige Circle may modify, withdraw, amend or add to any Rewards or other offers or arrangements. SCP will give as much advance notice as possible to Members.
14.2. Members shall be deemed to have agreed to any modifications, withdrawal, amendment or addition to the Rewards or Prestige Circle Points by registering on the app or website.

15. Variation of these Terms and Conditions

SCP reserves the right at all times without notice to make any changes to these Conditions.

16. Exclusion of liability

SCP will not be liable for any Loss resulting from alteration to, or termination of this scheme or the right to earn or redeem Prestige Circle Points.

17. Customer service

SCP is constantly trying to improve the Services it provides to its Members. Any Member with concerns or complaints should contact SCP directly. SCP may occasionally monitor telephone calls from Members to the service centre to maintain and enhance its service to Members.

18. Governing Law

18.1 To the extent permissible by local law or regulation these Conditions shall be governed by and construed in accordance with English law. SCP and each Member submits to the non-exclusive jurisdiction of the English courts to resolve any disputes that may arise out of them.
18.2 Any provision of these Conditions declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.
18.3. If there is any conflict in meaning between the English language version of these Conditions and any version or translation of these Conditions in any other language, the English language version shall prevail.
